Decree 286/2026 Is Live: What It Changes for a Mui Ne Run

In force since 15 September 2026. Real-time data sharing between immigration, police and border guards, a bigger role for your guesthouse, and the same Moc Bai reset at the end of it.

On 17 July 2026 the government signed Decree 286/2026/ND-CP. It took effect on 15 September 2026 and replaced Decree 64/2015, the rulebook that had governed how Vietnamese agencies talk to each other about foreigners for the last decade.

Most visa-run customers skim straight past this kind of news, and fair enough. A coordination decree between ministries sounds like paperwork about paperwork. But three things in this one touch people who live in Mui Ne on an e-visa, and they are worth ten minutes.

The agencies involved now share data in real time rather than on request. Your guesthouse's temporary residence declaration is part of that flow. And a Vietnam e-visa applied for while you are still inside Vietnam is easier to spot than it was in August. The short version: the Moc Bai loop has not gone anywhere, and a clean border reset is worth more, not less.

What It Actually Does

The decree sets a coordination mechanism between ministries, ministerial-level agencies and provincial People's Committees for managing the entry, exit, transit and residence of foreigners. That is the official summary. The parts that matter are narrower.

Real-time data exchange

The Ministry of Public Security, the Ministry of National Defence and the Ministry of Foreign Affairs now exchange immigration information, visa data, temporary residence records and security-related information as a matter of routine, not only when somebody files a request.

Pre-arrival visa data at land gates

The immigration agency must pass data on foreigners issued visas at border gates run by the Ministry of National Defence to those border-guard units before the traveller arrives. Moc Bai is a land gate on that list.

Immediate database updates

The Ministry of Foreign Affairs has to push visa and temporary residence card data to the National Immigration Database as soon as it issues them, or within five working days where the infrastructure is not ready. Paper trails used to lag for weeks.

A tighter list of what gets shared

Article 9(1) names visa issuance, investment and enterprise registration, work permits, practice licences, training and cooperation programmes, and conference agendas for anyone arriving on an e-visa or under visa exemption.

None of it criminalises anything you were doing legally. What it removes is the gap where one agency did not know what another had already stamped.

Your Guesthouse Is Now Part of the System

The clause that quietly matters most in Mui Ne is the temporary residence declaration. Under Articles 33 and 34 of the Law on Foreigners' Entry, Exit, Transit and Residence, hosting agencies and organisations have to coordinate with accommodation establishments to declare where a foreigner is staying. The decree restates that duty and wires it into the flow: border-guard posts and public security now exchange temporary residence declaration data for accommodation in border areas, special zones and tourism and service areas.

Mui Ne is a tourism and service area. Ham Tien is wall-to-wall guesthouses, resorts, boutique homestays and long-stay apartments, and almost every one files your declaration for you. What changed is that the filing is no longer an isolated slip of paper in a reception drawer. It feeds a system other agencies read.

Two practical things follow. Register properly when you check in: give the guesthouse your actual passport with the current entry stamp, not a photo on your phone, and confirm they have logged your stay. Long-stayers who drift between two or three places and let one slide are the ones who notice later. If you move mid-stay, tell the new place you are on an e-visa so they file it too.

It is not a reason to worry. It is a reason to stop treating check-in as a formality.

The shortcut that does not work

Filing an E-Visa From Your Balcony Is Harder to Hide

Every few months somebody in a Mui Ne guesthouse tries the same shortcut. Their e-visa is running out, they do not fancy a 12-hour round trip, so they open evisa.gov.vn on the balcony and file a fresh application from inside Vietnam.

It rarely worked before, and it is a worse idea now. The Vietnam e-visa portal issues electronically to applicants who are outside the country. Filing from a hotel in Ham Tien means declaring an entry point you are not going to use, while your last e-visa, your entry stamp and your temporary residence declaration all point to you being in Binh Thuan, not abroad.

Decree 286 closes the gap that used to exist between those records. Visa data reaches the National Immigration Database immediately after issuance, and the agencies holding your entry and residence records are sharing them as a matter of course. An application that contradicts the travel history sitting in the system is easier to catch than it was in August.

The consequence is simple. The legal reset is still a real exit and re-entry, and from Mui Ne that means the Moc Bai gate. The question everyone asks

Do I Still Need the Moc Bai Run?

Yes, and nothing in the decree gives you a way around it. What it changes is the quality of the paperwork behind the crossing, not whether you cross. On run day the experience is much the same. We collect you at your resort around 05:30, drive the roughly 265 km up through Phan Thiet, the CT.01 expressway and QL22, and reach the Moc Bai gate mid-morning while the counters are quiet. You exit, walk the couple of hundred metres into Bavet, get the Cambodia stamp, and come back.

What you might notice is a slightly longer look at the desk. If the officer already has your visa record loaded before you arrive, the conversation is shorter, but it does mean the story your documents tell has to line up. Passport, entry stamp, e-visa and the temporary residence declaration your guesthouse filed all need to agree.

The people who get slowed down are the ones with a muddy record: an overstay, a run they never quite cleared, or a hotel that forgot to file them. Decree 286 did not invent the consequences. Do I have to declare where I am staying?

The duty sits with the host and the accommodation, under Articles 33 and 34. In practice you register with your guesthouse on check-in using your passport and current entry stamp, and they file the temporary residence declaration. Mui Ne and Ham Tien sit in a tourism and service area, so that data can be exchanged between public security and border guard units.

Can I still apply for a Vietnam e-visa from inside Vietnam?

The portal issues to applicants who are outside the country, so a domestic filing was already fragile. Under the decree it is easier to spot, because visa data is pushed to the National Immigration Database immediately and your entry and residence records are already in the system. The legal reset remains an actual exit and re-entry at Moc Bai.

Why does it matter that border guards get visa data before I arrive?

Moc Bai is a land gate managed by the Ministry of National Defence. The decree requires the immigration agency to hand those border-guard units data on foreigners issued visas before the traveller arrives. The officer has your record loaded when you walk up, which usually means a shorter desk stop, but it also means your passport, e-visa and residence declaration need to tell one consistent story.
